Participation Agreement for The B.A.D. Operation

These Terms and Conditions (“Terms”) govern your access to and participation in The B.A.D. Operation, a program operated by The B.A.D. Project (“Company,” “we,” “us,” or “our”).
1. Acceptance of Terms
By accessing, enrolling in, or participating in The B.A.D. Operation (the “Program”), you acknowledge and agree to be bound by these Terms, our Privacy Policy, and any other applicable agreements or notices posted on our website.
If you do not agree to these Terms, you may not participate in the Program.
2. No Medical or Therapeutic Advice
The B.A.D. Operation is designed to promote mental and physical wellness through personal accountability, movement, and structured routines. It is not intended to diagnose, treat, cure, or prevent any disease or mental health condition.
You agree and understand that:
- The Program is not a substitute for professional medical, psychological, or therapeutic advice or treatment.
- We do not provide clinical services or medical supervision.
- You should consult a licensed healthcare provider before starting any new physical, mental, or dietary routine, especially if you have known medical or psychological conditions.
3. Voluntary Participation and Assumption of Risk
Participation in The B.A.D. Operation is voluntary. You understand and agree that:
- You are solely responsible for your choices and behaviors while participating.
- Physical and mental activities associated with the Program carry inherent risks.
- By participating, you accept all risks, including (but not limited to) injury, illness, emotional distress, and other adverse outcomes.
You release The B.A.D. Project and its officers, affiliates, volunteers, and representatives from any liability related to injuries, damages, losses, or other claims arising from your participation.
4. Age & Capacity to Participate
There is no formal age restriction; however, if you are a minor in your jurisdiction, participation should be supervised or supported by a responsible adult. By participating, you represent that you have the legal capacity to agree to these Terms or have obtained necessary consent.
5. Program Structure
The Program is structured into three primary tiers:
- SPARK Tier (Days 1–30)
- FUEL Tier (Days 31–90)
- FIRE Tier (Days 91–130)
Participants may complete self-guided milestones and may choose to submit evidence of progress in order to qualify for reward tiers (e.g., challenge coins, exclusive merchandise, or other recognition items).
The B.A.D. Project reserves the right to verify, deny, or request clarification for any submitted materials prior to granting rewards.
6. No Guarantee of Results
You understand that individual results may vary. We make no guarantees or warranties regarding outcomes, personal improvements, or reward eligibility based on your participation.
The Program is designed as a motivational and educational tool; it is up to the participant to complete it honestly and responsibly.
7. Submission of Materials
You may be asked to submit logs, journals, photos, or other documentation. By submitting any content:
- You affirm that it is truthful and your own work.
- You grant us a non-exclusive, royalty-free license to use, display, or publish anonymized submissions for promotional or testimonial purposes (unless otherwise requested).
- You may request removal of any personally identifiable submissions at any time.
8. Intellectual Property
All content related to The B.A.D. Operation—including text, logos, graphics, digital downloads, merchandise, and layout—is the exclusive property of The B.A.D. Project and protected under U.S. and international copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any materials without our express written permission.
9. Refunds & Purchases
Participation in the Program is free. Any associated products (digital or physical) are covered under our Refund and Return Policy.
10. Community Conduct
When engaging with others in person or online under The B.A.D. Project:
- You agree to respect all participants and staff.
- Harassment, discrimination, or disruptive behavior will not be tolerated.
- We reserve the right to block, remove, or ban participants who violate this code of conduct.
11. Limitation of Liability
To the maximum extent permitted by law, The B.A.D. Project is not liable for any indirect, incidental, punitive, or consequential damages arising from your participation. Our liability to you for any claim shall not exceed the amount you paid (if any) for physical products related to the Program.
12. Indemnification
You agree to indemnify and hold harmless The B.A.D. Project and its affiliates, officers, agents, employees, and volunteers from any claim, demand, loss, liability, or expense arising from:
- Your participation in the Program
- Your use of our content or services
- Your violation of these Terms or any applicable law
13. Privacy
We are committed to protecting your privacy. Any personal data collected will be handled in accordance with our Privacy Policy, and never sold or shared without your consent.
You may contact us at any time to request removal or deletion of your personal data.
14. Termination & Modification
We reserve the right to modify, suspend, or terminate The B.A.D. Operation at any time. We may also update these Terms periodically. Your continued participation constitutes acceptance of any changes.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any legal disputes shall be resolved in the appropriate courts of that jurisdiction.
